If he didn't see the sign then it didn't meet the legal requirement of being in a prominent place where people could reasonably be expected to see it, otherwise he would have seen the sign.

It doesn't make sense. Not being aware of your surroundings is no excuse. If it is in a prominent place where he could reasonably be expected to see it, it is irrelevant whether or not he was cognizant of it.
